FORD E-SERIES CUTAWAY VEHICLES INVESTIGATION

Edelson Lechtzin LLP is investigating potential class claims against Ford Motor Company concerning alleged defects in its Ford E-Series Cutaway vehicles. These vehicles are incomplete cutaway trucks. These vehicles are advertised to be used for a “wide range of commercial and recreational applications,” including recreational vehicles (“RVs”), box trucks and ambulances. To accommodate these intended applications, the vehicle’s gross vehicles weight rating (“GVWR”) is crucial. Ford specifically advertises the GVWR for each vehicle model.

However, it has been alleged that the Ford E-Series Cutaway vehicles cannot accommodate the stated GVWR because Ford designed and manufactured the vehicles with a suspension system that cannot be adjusted. As a result, the vehicle cannot be aligned after it has been built out into its final use (e.g., RV, box truck, or ambulance), and the vehicle will not track the road. Instead, the steering is unsafe and difficult as the vehicle will pull to one side of the road.

To remedy the situation, a user must purchase and have installed various aftermarket parts – costing hundreds if not thousands of dollars – to fix the suspension problems.

What vehicles are affected?

The Cutaway vehicles affected by the alleged defects include the following:

  • E-350 Single-Rear-Wheel Cutaway (advertised GVWR of 10,050 lbs.)
  • E-350 Dual-Rear-Wheel Cutaway (advertised GVWR from 11,500 lbs. to 12,500 lbs.)
  • E-450 Dual Rear-Wheel Cutaway (advertised GVWR of 14,500 lbs.)

Ford boasts that its E-Series’ GVWR ratings mean these vehicles “won’t quit when the going gets tough.” Unfortunately, many owners report that the Ford E-Series Cutaway vehicles cannot handle the claimed GVWRs.

Why is there a class action lawsuit?

Owners and lessees of Ford E-Series Cutaway vehicles have had to pay hundreds of dollars to fix this problem. And many vehicle-owners report that the steering and suspension problems persist even after attempted repairs.

To make matters worse, Ford and its dealers often refuse to provide warranty coverage for these expensive repairs.

The class action lawsuits seek monetary damages for owners and lessees of the affected Ford E-Series Cutaway vehicles under the federal Magnuson-Moss Warranty Act, and state law claims for breach of express and implied warranties.
