Unfair Price Inflation For Non-Bundled Vaccine Purchases
Edelson Lechtzin LLP is investigating whether Merck & Co. engaged in anticompetitive practices in violation of federal antitrust laws by allegedly requiring doctors to purchase bundles of childhood vaccines including the vaccine for the rotavirus known as RotaTeq. Merck allegedly gives customers for pediatric vaccines a discount if they purchase a bundle of vaccines. However, the requirement that the vaccines be purchased in a bundle eliminates competition and ultimately results in the price of the vaccines to be artificially high. Merck customers who don’t agree to purchase the bundle will not only face higher prices for RotaTeq but also for vaccines for hepatitis A and B, Hib, Varicella, MMR and HPV.
