JUUL Class Action Lawsuit – Vaping leads to Nicotine Addiction in Minors

Edelson Lechtzin LLP is investigating claims related to minors developing nicotine addictions after using JUUL vaporizers and nicotine pods.

JUUL vaporizers and nicotine pods are developed by JUUL industries. The company is facing allegations that their devices have caused many American minors to form nicotine habits despite the rate of traditional cigarette usage decreasing in the country. This would suggest that the JUUL is the first introduction to nicotine usage for many teens and children, rather than it replacing previous habits.

Mounting lawsuits allege that JUUL purposefully geared their products towards children and teenagers through their variety of flavors and other marketing strategies. JUUL has claimed that they sell their products as cigarette replacements that are intended to curb cigarette consumption and that they offer a safer alternative, but their vaporizers contain dangerously high levels of nicotine. A JUUL pod is the replaceable part of the vaporizer that holds the nicotine. One JUUL pod has about 40 mg of nicotine, which is approximately the same amount of nicotine found in a pack of traditional cigarettes. Many JUUL users easily finish one pod in a day, which leads minors to consumer deceptively high amounts of nicotine daily.

Nicotine is a highly addictive chemical that can be especially damaging to minors as it can impair brain development, which is a process that usually is not completed until their 20s. Young people are also more likely to become addicted than older users. Teenagers first get introduced to JUUL products by their friends and peers as it can be seen as a “cool and fun” new pastime. The small, slim design of JUUL vaporizers allows for them to be discreetly used and carried by minors without adults knowing. This poses a new public health problem as a whole new generation is becoming addicted to nicotine, which is a trend that had been on the decline prior to the introduction of JUUL and similar vape products.

Few studies have actually investigated the long-term effects of the chemicals in JUUL pods and the potential dangers they pose to habitual users. Little is known about the harm that JUUL might cause users many years down the line. More harmful chemicals and substances other than nicotine could be found in e-cigarette vapor. One clear risk associated with JUUL use is that it could lead your minor to start smoking real cigarettes. The use of cigarettes and other tobacco products are widely known to cause cancer and are believed to be responsible for over 480,000 deaths annually in the U.S. alone.

Nicotine addiction is not the only way that JUULs have been known to harm consumers. JUULs and other e-cigarettes have also been found to explode or combust in a way that physically harms its users.

JUUL industries is the leading figure in the e-cigarette industry and is heavily funded by large tobacco corporations. Their appeal to young people and minors can be identified as the reason for their strong market-share. Also, JUUL only provided warning labels on their products once they were legally forced to comply. These shady business tactics have led to tens of thousands of new underage addicts.

Edelson Lechtzin LLP wants to hold JUUL accountable for the harm it has caused to America’s youth. They have failed to adequately warn consumers of the danger of their vape products. If you or your child became addicted to nicotine after using JUUL products prior to turning 18 years of age or were harmed by JUUL in any other way, then you may be eligible for financial compensation. Our lawyers will fight for you and your case to rectify the damages done to you or your child.

JUUL Labs has recently reached a $40 million settlement with the state of North Carolina. This was to resolve claims that the company created a new public health challenge by leading many teenagers to develop nicotine addictions off their products. These funds will be allocated towards education and assistance related to youth e-cigarette addiction in the state. JUUL will also be forced to quit marketing techniques that were directed towards young people. This means that JUUL will no longer be able to sell flavors other than tobacco and menthol, and that they cannot advertise on social media. Thirteen other states have filed similar cases against the e-cigarette company.
