The Class Action Complaint alleges that Bostik has failed to properly pay employees for time spent dressing in their PPE prior to their shifts and removing this equipment after the end of their shifts. Bostik also requires employees to work long shifts without properly allowing employees to take scheduled meal and rest breaks. The Complaint alleges that these practices violate the federal Fair Labor Standards Act (“FLSA”) and the Kentucky Wages and Hours Act (“KWHA”).

The 401(k) retirement plan participants allege that the Plan’s fiduciaries selected and retained certain actively managed funds with excessively high fees that underperformed other available alternatives including lower-cost index funds.
