The massive Connexin Software Inc. data breach spawned at least nine class action lawsuits, which have been consolidated in the United States District Court for the Eastern District of Pennsylvania. Numerous law firms sought leadership positions in this case, and on March 30, 2023, the Court issued a decision appointing lead counsel and Plaintiffs’ Steering Committee to oversee the litigation.

What’s the case about?

On September 13, 2022, Connexin, which operates under the name Office Practicum, learned that an unauthorized party had penetrated their network and had access to extensive confidential patient data. Following this discovery, Connexin issued a statement notifying more than 2.2 million people about the data breach.

The data breach is alleged to have compromised sensitive personal information about pediatric patients and their parents or guardians, including Social Security Numbers, patient demographic information, health insurance information, and medical information.

Why did the court appoint lead counsel and Plaintiffs Steering Committee?

Under Rule 23(g)(3) of the Federal Rules of Civil Procedure, a federal court is empowered to appoint interim lead counsel “to act on behalf of a putative class before determining whether to certify the action as a class action.”

In selecting the lead attorneys for this important case, the Court considered the following factors: “(i) the work counsel did to identify and investigate the claims; (ii) counsel’s experience with class actions, other complex litigation, and the types of claims asserted; (iii) counsel’s knowledge of the applicable law; and (iv) the resources counsel can commit to represent the class.”

Based on these criteria, the Court determined that the lead counsel and the members of Plaintiffs Steering Committee, including Edelson Lechtzin LLP, would be best able to represent the interests of the proposed class.
