How Could I Have Been Underpaid?

The lawsuit alleges that Alliance coal miners were required to arrive at the mine before their shifts began to dress and get ready for work. During this time, workers put on special protective equipment and clothing, including coveralls, boots, safety glasses, hearing protection, gloves and helmets, according to the suits. They also used this time to gather additional tools and materials needed to perform their jobs.

The lawsuits argue that this time should be considered work time – even though it’s performed prior to scheduled shifts – and must be paid. Alliance, however, allegedly does not provide compensation for this pre-shift work.

The lawsuit also alleges Alliance illegally failed to pay workers for time spent working after their shifts ended. During this time, workers removed their clothing and protective equipment, returned items to their lockers and placed lights on chargers so they could be ready for future shifts.

The suits also allege Alliance cheated workers out of proper overtime pay when they worked more than 40 hours per week.
